The above mentioned cheque/cheques on due presentation through my banker for encashment within it validity period, was returned unpaid vide cheque/cheques return memo dated ……… with the endorsement “( Bank Name , Branch Name )”. Photocopy of the return cheque/cheques  along with return memo of the bank are enclosed for your perusal.

It may further be mentioned that under Section 139 of the said Act, there is a presumption that the cheque/cheques above mentioned had been issued in discharge of a legally enforceable debt/liability owed by you.

In view of the aforesaid, I/We do hereby call upon you and demand you to pay me/us the aforementioned amount of Rs. ………………… (Rupees ……………………………………. only) the amount of the said dishonoured cheque/cheques by pay order or bank draft or RTGS/NEFT or in cash within 15 days from the date of receipt of this notice, failing which, I /We will be constrained to institute legal proceedings against you under the provisions of Negotiable Instruments Act, 1881 as amended up-to-date, which will render you liable to be punished with imprisonment which may extend to two years or with fine which may extend to twice the amount of the cheque or with both.

Also please find enclosed a Debit Note No.......... date.………….…. for Rs. …………..…… towards bank charges and interest @ ……. p.a. for 15 days on the amount of the cheque.

Please treat this letter as a notice u/s 138(b) of the Negotiable Instruments Act, 1881 as amended up-to-date and your failure to comply with the aforesaid the above mentioned proceedings under the provisions of the Negotiable Instruments Act shall be initiated against you without any further reference to you.
