Subject: Restore electricity connection to Stabnet Tyres Ltd consumer No. 010519123456
This is in
reference to the Stabnet Tyre Ltd electricity disconnection by you, please note
that Stabnet Tyres Limited is under the Corporate Insolvency Resolution Process
with effect from November 30, 2025 as per the order passed by National Company
Law Tribunal (“NCLT”), Mumbai & I
have been appointed as the Resolution Professional.
1) As per IBC (Insolvency
and Bankruptcy Code, 2016) the entire liability of
Stabnet Tyres Ltd is to be kept at abeyance. Any claims by the creditor are at
liberty to fill the requisite forms in the capacity of being an operational
creditor. In such situation your action of disconnecting the electricity
connection is in contrary with the provisions of the IBC.
2) NCLAT has
issued an order that Stabnet Tyres Limited should be an ongoing concern. Based
on this order, the disconnection of the electricity by you to Stabnet tyres ltd
will be in contrary to the order passed by the Hon’ble NCLAT.
3) In terms of the
clause 8 of the order, The supply of essential goods or services to the
corporate debtor shall not be suspended or interrupted during “Moratorium
Period”.
4) Moreover there
has been no power & production in the Stabnet Tyres Factory & you have been
raising such a high demand till present for the reasons best known to you.
In view of the
same we are requesting you to restore the electricity connection immediately
& withdraw the arbitrary bills raised on Stabnet Tyres Ltd.
