AFFIDAVIT
Affidavit Format for Guaranteeing a Loan
I, Aman Biswas S/o ___________________ aged about ______ years having PAN No. ________ and residing at __________________________________do hereby solemnly affirm and declare on oath as follows:-
- That
Stabnet Infrastructure (Private) Limited, a
company incorporated under the Companies Act, 1956 and having its
registered office at S-10, Duncan Road Block -C, 4th Floor, Mumbai-
400001 (CIN No. U62217MB2193PTC0123456) and its corporate office at D-12, Vidya
Path, Chandigarh -160001 (hereinafter referred to as
the “Lender” has at my request granted/and/or agreed to grant a
Loan of Rs.7.00 Crores (Seven Crores Only) to the borrower Raja Traders
Ltd. having CIN No. L18529RA1285PLC123456 and
its registered office at Tolstoy Marg, Delhi-110001, interalia, against my guarantee and
hence, this affidavit is being sworn by me to satisfy the said Lender as
to the credentials of the Borrower and the other Guarantor namely Sachin Properties Finance Private Ltd. having CIN No. U62217MB2193PTC1234565
and its registered office at Duncan Road, Mumbai- 400001 (hereinafter
referred to as “Sachin”)
- That
Dadar is lawful owner of two residential
apartments bearing No. 1501 and 252 at Basundhara Apartment, 15, Manek
Chowk, Ahmedabad - 380001 each admeasuring 2650 Sq. ft. or thereabouts
together with right to the common areas and services (including relevant and
respective parking space allocated against said residential apartment(s))
and further including all fixtures and fittings.

That the said Residential
Property(ies)were earlier owned by Amar Electrical and Investment Co. Ltd. (CIN
No. U41531SB1655SLC123456) and SAL (India) Pvt. Ltd. (CIN No. U51109WB1556PTC012345),
respectively and each of the said companies have since been amalgamated with Sachin
vide an order of the High Court at Calcutta dated 15th February, 2025
and in terms whereof the said Property(ies)are represented by way of advances
to M/s Ajit Chandra and Prem Chandra having an aggregate amount of Rs. 52,08,071
and Mr. Vimal Kumar having an aggregate amount of Rs. 31,60,773, respectively.
The said advances have not been withdrawn till date and are part of the title
documents with respect to the said Residential Property (ies).

That the only documents of title with
respect to the said properties available with Sachin are the payment receipts,
the respective Agreement(s) to Sell and the respective Possession Letter(s),
all of which have been have been handed over by Sachin to the Lender for the
purposes of creation of Equitable mortgage thereon.

That Sachin is the sole owner of
the said residential properties as on the date of this affidavit and that the
no prior charges, mortgage or other encumbrances which existsthereon nor are the
said properties subject matter of any attachment, agreement to sell or
conveyance deed or any similar agreement which is to the detriment of the
rights of the Lender as mortgagee of the said properties.
- That the Statements/declarations
made by me in paras 1 to 5 set out above are true and correct to the best
of my personal knowledge and belief and that I am competent to swear this
affidavit.
