Sub: Request for Stay of Demand
Recovery.
We acknowledge
the receipt of the above demand notice dated 17th July 2025 asking
to pay arrears of sales tax dues of Rs 113,17,35,553/- pertaining to the period
2016-2017,2017-2018,2018-2019 and 2020-2021.
We would like to
inform your honor that we have preferred an appeal against the assessment
orders. The appeal is pending before the Hon’ble Joint Commissioner of sales
Tax (Appeal)-V, Mumbai.
We wish to
inform you that we had collected various forms and other documents for
submission before Hon’ble Joint Commissioner of sales Tax (Appeal)-V, Mumbai.
Unfortunately fire broke out at our office at Dakivali village, Bhiwandi-Wada
Road,Tal.-Wada ,Dist.-Palghar on 24.01.2025 (Copy of letter from Fire
Department enclosed and marked Annexure - B), our administrative office
and accounts building was fully damaged resulting loss of documents and assets
in fire.
We earnestly
approached Hon’ble Joint Commissioner of sales Tax (Appeal)-V, Mumbai for
reasonable longer period of time to submit these documents for assessments.
We have applied
for issue of NOC before Hon’ble Joint Commissioner of sales Tax,Palghar for
various state commercial department to issue duplicate form destroyed in fire,
which is pending and to be received shortly.
Your honour we
will like to brief your various problems faced by the company during last five
years. Stabnet Tyres Ltd is a well-known name in the tyre industry. The company
has been selling tyres not only domestically but also exporting to various
countries all over the world. Our company is growing rapidly but the following
factors has put us into financial crisis.
1-Fire in the Factory in 2020.
There was a fire
in the factory in 2020 which disrupted suddenly production heavily and put a
halt to our rapidly growing progress. This was heavy loss incurred due to fire.
We lost production due to fire. Our sale went down. This put our company into
financial crisis
2-Labour Trouble in 2021
Before we could
recover from the fire loss, there started labour problem in the factory. The
Labour trouble forced closure of the factory and loss of production, sale and
affected our profitability greatly. This further aggravated our financial crisis.
The company incurred heavy loss.
3 Slow down of production due to labour trouble
The worker
started creating problem by not giving production as per standard norms. This
resulted in increasing cost affecting profitability. This resulted in heavy
loss. Ultimately we were forced to close the factory from Jan 2023 which
continued up to Feb 2024.
4. Fire in the Factory in 2025
Unfortunately
fire broke out at our office at Dakivali village, Bhiwandi-Wada Road,Tal.-Wada
,Dist.-Palghar on 24.01.2025 our administrative office and an account building
was fully damaged resulting loss of documents and assets in fire.
In case if the
company is made to pay this demand forcibly, the business of the company will
be ruined and all our efforts for revival and survival will be in vain.
We would request
your honor to give us an opportunity to explain further on the above facts to
your honor and shall keep requesting your honor to keep the above demand in
abeyance till the appeal is disposed off for the sake of natural justice and
special circumstances in which the company has been put in due to unforeseen
circumstances.
